Terms of Use

1. Introduction and Acceptance

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and APPCODIX LTD, a company registered in Cyprus, located at Spyrou Kyprianou & Agias Fylaxeos, 182 KOFTEROS BUSINESS CENTRE, 3083 Limassol, Cyprus ("Company", "we", "us", "Homind").

By downloading, installing, accessing, or using the Homind application ("App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms become effective upon posting within the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

3. Eligibility

The App is intended for users who are at least 18 years of age. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you may not download, install, or use the App.

4. Description of the App

Homind is an AI-powered interior and exterior design application. The App allows you to upload photos of rooms or spaces and receive AI-generated design visualizations, including but not limited to interior staging, redesign, texture changes, floor planning, and 3D model creation.

YOU ACKNOWLEDGE AND AGREE THAT THE APP USES EXPERIMENTAL AI TECHNOLOGY AND MAY SOMETIMES PROVIDE INACCURATE, INCOMPLETE, OR UNEXPECTED CONTENT. AI-GENERATED RESULTS ARE FOR INSPIRATION AND VISUALIZATION PURPOSES ONLY AND SHOULD NOT BE RELIED UPON AS PROFESSIONAL ARCHITECTURAL, INTERIOR DESIGN, OR CONSTRUCTION ADVICE.

We are not responsible for any decisions, purchases, renovations, or other actions you take based on AI-generated content. We strongly recommend consulting with qualified professionals before making changes to any space.

5. User Accounts

The App uses anonymous, device-based accounts. No personal registration information (such as name or email) is required to use the App.

6. User Content

6.1 Definitions

• Input Content: Photos, images, and any other content you upload to or provide through the App.
• Output Content: AI-generated images, designs, floor plans, 3D models, and any other content generated by the App based on your Input Content.
• User Content: Collectively, your Input Content and Output Content.

6.2 Your Rights

You retain all ownership rights to your Input Content. Subject to these Terms, you also own the Output Content generated from your Input Content and may use it for both personal and commercial purposes.

You acknowledge that AI-generated Output Content may not be unique. Other users providing similar Input Content may receive similar or identical Output Content. We make no guarantees of uniqueness or exclusivity.

6.3 License Grant to Homind

By using the App, you grant APPCODIX LTD a worldwide, non-exclusive, royalty-free, sublicensable license to:

• Process your Input Content through AI providers to generate Output Content;
• Store your Input Content and Output Content on our servers as described in our Privacy Policy;
• Use Input Content and Output Content to evaluate, analyze, and improve the quality of the App and its AI-generated results;
• Use Output Content for marketing, promotional, and showcase purposes, including but not limited to displaying results on our website, App Store listings, and social media channels.

This license survives termination of your account with respect to content already processed. We will not publicly associate your Output Content with your identity without your consent.

6.4 Your Responsibilities

You represent and warrant that:

• You have the right to upload all Input Content and that it does not infringe on any third party's intellectual property rights, privacy rights, or other legal rights;
• Your Input Content does not contain illegal, harmful, abusive, obscene, or otherwise objectionable material;
• You will not upload photos of minors (persons under 18);
• You will not upload content that is sexually explicit, promotes violence, or constitutes hate speech;
• You will not misrepresent AI-generated Output Content as human-created when it is not obvious that the content was generated by AI;
• You will comply with all applicable laws and regulations when using User Content.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws;
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App;
• Modify, adapt, translate, or create derivative works based on the App;
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use any automated system, bot, scraper, or similar technology to access the App;
• Use the App or its data for developing, training, fine-tuning, or validating any AI system or model;
• Interfere with or disrupt the App's servers, networks, or infrastructure;
• Attempt to gain unauthorized access to the App, other users' data, or our systems;
• Use the App to generate content that infringes upon intellectual property rights of third parties;
• Harass, abuse, or engage in disrespectful behavior toward our customer support staff;
• Circumvent or attempt to circumvent any usage limits, subscription restrictions, or technical protections.

8. Intellectual Property

All rights, title, and interest in and to the App, including but not limited to its design, code, features, functionality, trademarks, logos, and any associated content (excluding User Content), are owned by APPCODIX LTD or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal or commercial design purposes in accordance with these Terms. This license does not include the right to sublicense, sell, resell, or commercially exploit the App itself.

9. Subscriptions and Payments

9.1 Subscription Plans

The App offers subscription-based access to its features. Subscription plans, pricing, and available features may vary depending on your country, region, and the time of purchase. Please refer to the App for current pricing and plan details.

9.2 Usage Limits

Each subscription includes a limit of 30 AI generations per week. This limit applies across all generation types. Unused generations do not carry over to the following week.

9.3 Free Trial

Some users may be offered a free trial or an introductory offer (for example, a 3-day or 7-day trial). Trial availability, duration, and pricing of introductory offers are not guaranteed and may vary. If a trial converts to a paid subscription, you will be charged at the end of the trial period unless you cancel before the trial ends.

9.4 Payment and Auto-Renewal

All payments are processed through your Apple ID account via the App Store. By subscribing, you authorize Apple to charge your payment method on a recurring basis. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the current period expires.

9.5 Cancellation

To cancel your subscription:

1. Open the Settings app on your iPhone or iPad.
2. Tap your name at the top (Apple ID).
3. Tap Subscriptions.
4. Select Homind.
5. Tap Cancel Subscription and confirm.

Deleting the App does not cancel your subscription. You must cancel through your device settings as described above. Your subscription remains active until the end of your current billing period. No refunds are provided for partial billing periods.

9.6 Refunds

All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. APPCODIX LTD does not process refunds directly.

10. Third-Party Services

The App relies on third-party services to provide its functionality. These include, but are not limited to:

• AI Providers: Google Gemini, OpenAI, xAI, Runware (Flux) — for generating AI design content
• Cloud Infrastructure: Hetzner — for server hosting
• File Storage: Cloudflare R2 — for storing uploaded and generated images
• Analytics: Firebase Analytics, Amplitude, Adjust
• Subscription Management: RevenueCat
• Messaging: OneSignal

Each third-party service is governed by its own terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services. By using the App, you acknowledge that your data may be processed by these third-party providers as described in our Privacy Policy.

11. Availability and Accuracy

We do not guarantee that the App will be available at all times, uninterrupted, secure, or error-free. We may suspend, modify, or discontinue any part of the App at any time without prior notice.

The AI-generated content provided through the App is produced by machine learning models and may contain inaccuracies, artifacts, or unexpected results. We do not warrant the accuracy, completeness, reliability, or suitability of any generated content for any particular purpose.

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, APPCODIX LTD DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, CURRENT, OR FREE FROM ERRORS. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL APPCODIX LTD, ITS DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED EUROS (EUR 100), WHICHEVER IS GREATER.

14. Indemnification

You agree to indemnify, defend, and hold harmless APPCODIX LTD, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:

• Your use of the App;
• Your User Content;
• Your violation of these Terms;
• Your violation of any applicable laws or third-party rights.

15. Apple App Store Terms

You acknowledge and agree that:

• These Terms are between you and APPCODIX LTD only, not with Apple Inc. ("Apple");
• APPCODIX LTD, not Apple, is solely responsible for the App and its content;
• Apple has no obligation to provide maintenance or support for the App;
• Apple is not responsible for any product warranties, whether express or implied;
• Apple is not responsible for addressing any claims relating to the App;
• Apple is a third-party beneficiary of these Terms, and upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary;
• You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not listed on any U.S. Government list of prohibited or restricted parties.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Limassol, Cyprus.

17. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination:

• Your license to use the App immediately ceases;
• We may delete your data, including stored Input Content and Output Content, in accordance with our Privacy Policy;
• Sections of these Terms that by their nature should survive termination (including but not limited to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

You may stop using the App at any time. If you have an active subscription, please cancel it through your device settings to avoid further charges.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and APPCODIX LTD regarding your use of the App and supersede all prior agreements and understandings.
